1. Recitals
To help Dusit Gold members (the "Member") fully understand the Dusit Gold Programme's special services, benefits and awards (the"Programme"), the following terms and conditions ("Terms and conditions") have been prepared as a reference. Unless specifically stated otherwise, these terms and conditions will apply to all Members.
The following terms and conditions shall govern participation in the Programme and create a legally binding agreement between Dusit Hotels & Resorts and the Members. It is thus the Member's responsibility to read and understand all of the terms and conditions. These terms and conditions shall be governed by and construed in accordance with the laws of Thailand. Both Members and Dusit Hotels & Resorts hereby irrevocably submit to the exclusive jurisdiction of the courts of Thailand.
All interpretations of these terms and conditions shall be at the sole discretion of Dusit Hotels & Resorts. However, the terms and conditions and Dusit Gold benefits and award use are subject to change at any time without prior notice.
2. General
2.1 The benefits, rewards and privileges received from participating the Programme (the "Benefit") is individual for each Member. The benefits to Members will be closely tailored to their individual preferences and needs in order to constantly exceed expectations through guest experiences. Dusit Gold Member Benefits are determined by each participating hotel, resort and restaurant individually and are not standardised across participating hotels, resorts and restaurants enrolled in the Programme.
2.2 The Programme offers direct benefits at hotels operated as Dusit Thani Hotels & Resorts, Dusit Devarana Hotels & Resorts, dusitD2 Hotels & Resorts, Dusit Princess Hotels & Resorts, ASAI Hotels or any other hotel brand owned, managed, operated, franchised or leased by Dusit International or its subsidiaries or affiliates (collectively the "Participating Hotel").
2.3 The Programme may continue until such time as Dusit Hotels & Resorts at its sole discretion elects to designate the Programme termination date. Dusit Hotels & Resorts has the right to end the Programme at any time without prior notice.
2.4 Dusit Hotels & Resorts may, without notice, discontinue Dusit Gold Membership ("Membership") if the Member fails to promptly pay hotel bills or appears to be utilisng the Programme in a manner inconsistent with these terms and conditions or the intent of the Programme, including, but not limited to, Dusit Gold benefits and awards use.
2.5 Dusit Hotels & Resorts may discontinue Membership of any Member who acts in an abusive manner or in a manner inconsistent with local, state or federal laws.
2.6 Discontinued Membership will result in the loss of all benefits and the Dusit Gold account will be closed.
2.7 The sale or barter of benefits (including other rewards and benefits received from the participating to the programme) are prohibited. If any of them have been transferred, sold or assigned for such purposes, they may be confiscated or cancelled.
2.8 In the event that any participating hotel ceases to operate as Dusit Thani Hotels & Resorts, Dusit Devarana Hotels & Resorts, dusitD2 Hotels & Resorts, Dusit Princess Hotels & Resorts, ASAI Hotels or any other hotel brand owned, managed, operated, franchised or leased by Dusit International or its subsidiaries or affiliates, the benefits will not be available for stays at the participating hotels, nor will the benefits be available after the termination date at such participating hotels, even if the reservation was made prior to the termination date.
2.9 Members must be at least 18 years of age and the age of majority in their state or province of residence. Individuals are only eligible to have one Dusit Gold membership account. Memberships cannot be shared or combined by more than one person. Corporations, associations, or groups cannot enroll in the Programme except clearly express in the terms and conditions. Individuals working in Dusit Hotels & Resorts's corporate and divisional offices as well as individuals working at any Participating Hotel (collectively "Associates") may participate in the Programme. Room nights and stays booked on staff or friends and family rates are however not eligible for status upgrades.
3. Dusit Gold Programme Hotel Services
3.1 To be eligible to receive the Benefits, the Member must provide their Membership name or number when making a reservation and notify Participating Hotels at check-in. The Benefits are only applicable at Participating Hotels and their services are subject to availability. Membership at no point in time constitutes a right to receive certain Benefits. It is at the sole discretion of Participating Hotels to avail any Benefits as appropriate.
3.2 Dusit Hotels & Resorts will make best-faith efforts to deliver specified Benefits to Members. However, not all Benefits can be provided at all Participating Hotels. Dusit Hotels & Resorts or Participating Hotels shall not be liable for refunds or for consequential damages resulting from failure to deliver such services.
3.3 The Membership card is not a credit card and all standard hotel credit procedures, including the presentation of an authorised credit card, apply.
4. Silver, Gold and Platinum Membership
The Programme offers three Membership tiers – Silver, Gold and Platinum. Members may earn tier upgrades by accumulating a fixed number of eligible nights or points in a calendar year from eligible stays* at Participating Hotels as shown in the table below. The tier qualifiers as well as terms and conditions are subject to change without notice.
To receive the Benefits toward tier status of the Programme, Members must pay an eligible rate for at least one night of their stay. A night is defined as the total number of consecutive nights spent at one Participating Hotels. A Member will not receive the Benefits toward tier status or toward any promotion for the nights if the Member pays an ineligible rate or nights that are placed on a group Master Account (for example, Master Accounts paid by a convention, association or group). Qualifying nights or points will only be accounted for after the Members complete their stay and are checked out of the Participating Hotel.

4.1 Silver Membership
Silver Membership will be given to Members on sign up. No minimum number of nights or points required.
4.2 Gold and Platinum Memberships
Gold or Platinum Memberships will be given to Members who, in one year from application date or tier-level change date, record the required minimum number of nights or points at eligible rates and provide a valid Membership number at time of reservation or check-in. Members will not receive credit toward tier status or promotions for nights when ineligible rates are paid. Gold or Platinum Memberships are valid as long as the minimum annual required nights or points are met. When a Member is paying for more than one room, only the room in which the Member stays will count toward Gold or Platinum Memberships.
4.2.1 Redemption nights are only available at participating properties and, if a Member accumulates the required number of points for redemption. Properties participating in the Dusit Gold Programme are subject to change at any time without prior notice.
4.2.2 Redemption nights are not transferable and cannot be combined with other promotions and not combinable on the same dates with other awards, upgrade certificates, partner awards, certificate discount or benefits, incentive travel awards, gift vouchers, checks or any other special offer.
4.2.3 Redemption nights are non-commissionable or redeemable for cash and considered void if sold for cash or other consideration.
4.2.4 Member spend that was used to calculate redemption points may not be reused.
4.2.5 Dusit Hotels & Resort reserve the right to redemption nights or individual accounts at any time without prior notice
4.3 All Members
4.3.1 All Members will be offered Points Awarding benefits at Participating Hotels when staying on eligible rates only.
4.3.2 To qualify and maintain the consecutive year of Membership account levelled the same tier, minimum nights or points at any Participating Hotels are required based on Membership tier level otherwise downgrade and termination of Membership may be applied without notice.
4.3.3 To qualify and upgrade the consecutive year of Membership account levelled on a higher tier. Minimum nights or points at any Participating Hotels are required to upgrade to the next Membership level within a full calendar year.
4.3.4 Eligible stays at Participating Hotels do not include any stay at non-participating hotels and resorts or any other non-participating hotel brand owned, managed, operated, franchised or leased by Dusit Hotels & Resorts or its subsidiaries or affiliates.
4.3.5 Member earns eligible nights and points for one room only per stay regardless of the number of rooms booked during the same stay period.
4.3.6 If more than one member stays in the same room, at an eligible rate, the eligible nights and spend will only be counted for one of the members.
5. Maintaining Account Information
5.1 When Member enrolls in the Programme, Member will be assigned a Membership number and be required to create a unique password that will allow the Member to access account information, detail of benefits on www.dusit.com.
5.2 Member can change password by updating their personal Membership profile online. If Member chooses to change a password, the password should be memorable password and should be a strong password to reduce the overall risk of security breach. Special characters such as @#$%^&*;:/ may not be permitted. Dusit Hotels & Resorts is entitled to act on instructions received under Membership number and personal information. For security purposes, it is recommended that Member memorises the password and not write it down. Member is responsible for keeping password, Membership number and other account information confidential. Dusit Hotels & Resorts is not responsible for any usage of Member's account by anyone else using Member's password.
5.3 A Member must provide name or the Membership number and verify personal information prior to receiving any account information. Individual account information will not be given to anyone other than the Member whose name appears on the Membership account unless required in connection with a law enforcement investigation or by legal process.
5.4 Any errors or omissions on transactions posted to Membership account must be reported in writing to Customer Service of the Programme within 90 days of the transaction for the Programme to reconcile the Membership account and make any required adjustments to Membership account. Members must enclose a photocopy of the applicable complete hotel bill and payment receipt when reporting any error or omission in Membership account.
5.5 If the Programme improperly and not reasonably cause denies Benefit, Dusit Hotels & Resorts's liability will be limited to the equivalent of the Benefit.
5.6 The Programme has the right to correct any Member stays posted in error.
5.7 The Member is responsible for notifying the Programme of any address or name change. Name changes must be supported by a certified true copy of legal documentation, for example, marriage certificate, household registration, driver's license or legal court document.
6. Copyright and Trademark Notices
Any and all Intellectual Property associated with the Programme and its contents are the sole property of Dusit Hotels & Resorts. The Content is protected by Copyright, Trademark and other laws.
7. Liability Disclaimer
The information, products, and services advertised to Members may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Dusit Hotels & Resorts makes no representations about the suitability of the information, products and services contained in any media as it is provided 'as is' without a warranty of any kind.
Dusit Hotels & Resorts hereby disclaim all warranties (including those implied) and conditions of merchantability, fitness for a particular purpose, title, and no infringement about the information, software, products, and services provided. In no event shall Dusit Hotels & Resorts be liable for any direct, indirect, punitive, incidental, special, or sequential damages arising out of or in any way connected with the use of the Programme or with the delay or inability to use the Programme, or for any information, products, and services obtained through this Programme, or otherwise, even if Dusit Hotels & Resorts have been advised of the possibility of damages.
8. No Unlawful or Prohibited Use
As a condition of your use of the Programme, you warrant that you will not use the Programme and/or the Benefit for any purpose that is unlawful or prohibited by these terms, conditions, notices or any applicable laws
9. Privacy Policy
Member’s personal information will be processed in accordance with the Privacy Policy.
